TERMS AND CONDITIONS

1.0 Introduction

KLYFG VENTURES (KLYF GHANA or KLYF DELIVERIES) is an online marketing platform consisting of a Website, Facebook page, Instagram Page, (Marketplace) together with other digital and non-digital platforms for marketing goods and services to consumers in Ghana. 

The following Terms & Conditions shall by binding on both buyers and sellers who use our marketplace:

2.0 Registration and Account

i. Our marketplace is eligible to everyone above the age of 18 (Klyf Ghana shall regard all registered buyers and sellers as persons above the age of 18).

ii. All persons (both buyers & sellers) will be required to complete a form and choose a password that should be confidential only to the owner of the account. 

iii. Accounts shall be used only by the owner and cannot be transferred to a third party or whatsoever. All transactions carried out through a user account shall be at the risk on the owner of the account. 

iv. Klyf Ghana may suspend or cancel accounts at any time without notice or explanation provided that the activities of the account owner breaches the terms and conditions of the marketplace. 

v. An account owner may also cancel his/her account by contacting the management of KLYF GHANA on info@klyfghana.com

3.0 Sellers Terms and Conditions

The following provisions shall be binding on sellers who market on our KLYF GHANA market place.

i. The price of product by sellers must be stated clearly in the marketplace.

ii. Price of product must include all taxes and comply with applicable laws in force.

iii. Cost of delivery, packaging, insurance, administrative and other miscellaneous charges shall only be payable by the buyer if this is clearly stated in the product details.

iv. Products must meet a satisfactory quality, fit and safe for the purpose stated in the product description.

v. The seller warrants that, the seller has good title to, and is the sole legal and beneficial owner of the product, and that the product are not subject to any third party right or restriction.

vi. Breach to the sellers terms and conditions may attract sanctions which may include suspension or termination or sellers accounts. 

4.0 Payments

Payment for products ordered from the marketplace must comply with the terms and conditions binding the marketplace.

i. Klyf Ghana accepts two (2) way payment modes, ie. Cash on Delivery and Paystack.

ii. Cash on delivery is only eligible for deliveries within Accra.

iii. Goods purchased from abroad shall be paid through paystack before an order will be confirmed. 

5.0 Returns and Refunds

i. Returns of products by buyers and acceptance of returned products shall by handled by Klyf Ghana in accordance with the use of discretion, subject to compliance with applicable laws of the country. 

ii. Refunds in respect to returned products shall also be managed by KLYF GHANA in accordance with refund policies of the marketplace, and this shall be amended from time to time. 

iii. Customers have 24hrs to lodge a complaint of product and products are to be returned within 3days after receipt of product. 

iv. Goods destroyed as a result of buyers negligence shall not be accepted by KLYF GHANA upon return. 

v. Good purchased from abroad cannot be returned by buyers. 

Changes to our returns page or refunds page shall be effective in respect of all purchases made from the date of publication of the change on our website.


6.0 Copyright and trademarks

i. KLYF GHANA’s logos and other unregistered trademarks are assets to KLYFG VENTURES, and we give no permission whatsoever for these trademarks, and such use may be regarded as an infringement of our right. 

7.0 Privacy

7.1 What Personal Information About Customers Does Klyf Ghana Collect?

We collect your personal information in order to provide and continually improve our products and services.

Here are the types of personal information we collect:

Information You Give Us: We receive and store any information you provide in relation to Klyf Ghana Services. You can choose not to provide certain information, but then you might not be able to take advantage of many of our Services.

Automatic Information: We automatically collect and store certain types of information about your use of our Services, including information about your interaction with content and services available. Like many websites, we use "cookies" and other unique identifiers, and we obtain certain types of information when your web browser or device accesses Klyf Ghana Services and other content served by or on behalf of Klyf Ghana on other websites. 

Information from Other Sources: We might receive information about you from other sources, such as updated delivery and address information from our carriers, which we use to correct our records and deliver your next purchase more easily

7.2 Use of Personal Information?

We use your personal information to operate, provide, develop, and improve the products and services that we offer our customers. These purposes include:

Purchase and delivery of products and services. We use your personal information to take and handle orders, deliver products and services, process payments, and communicate with you about orders, products and services, and promotional offers.

Provide, troubleshoot, and improve Klyf Ghana Services. We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Klyf Ghana Services.

Recommendations and personalization. We use your personal information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with Klyf Ghana Services.

Comply with legal obligations. In certain cases, we collect and use your personal information to comply with laws. For instance, we collect from sellers information regarding place of establishment and bank account information for identity verification and other purposes.

Communicate with you. We use your personal information to communicate with you in relation to Klyf Ghana Services via different channels (e.g., by phone, email, chat).

Advertising. We use your personal information to display interest-based ads for features, products, and services that might be of interest to you. We do not use information that personally identifies you to display interest-based ads. 

Fraud Prevention and Credit Risks. We use personal information to prevent and detect fraud and abuse in order to protect the security of our customers, Klyf Ghana, and others. We may also use scoring methods to assess and manage credit risks.


7.3 Does Klyf Ghana Share Your Personal Information?

Information about our customers is an important part of our business, and we are not in the business of selling our customers' personal information to others. We share customers' personal information only as described below and with subsidiaries controls that either are subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

Transactions involving Third Parties: We make available to you services, products, applications, or skills provided by third parties for use on or through Klyf Ghana Services. For example, you can order products from third parties through our stores. We also offer services or sell product lines jointly with third-party businesses, such as co-branded credit cards. You can tell when a third party is involved in your transactions, and we share customers' personal information related to those transactions with that third party.

Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders for products or services, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, scoring, assessing and managing credit risk, and providing customer service. Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. Also, in the unlikely event that Klyf Ghana or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

Other than as set out above, you will receive notice when personal information about you might be shared with third parties, and you will have an opportunity to choose not to share the information.

7.4 How Secure Is Information About Me?

We design our systems with your security and privacy in mind.

We work to protect the security of your personal information during transmission by using encryption protocols and software.

We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of customer personal information. Our security procedures mean that we may ask to verify your identity before we disclose personal information to you.


8.0 Breach of General Terms and Conditions

If an account holder breaches the general terms and conditions of the marketplace, or if we reasonably suspect that an account holder have breached the general terms and conditions of Klyf Ghana, we may:

i. Temporarily suspend the account from the market place

ii. Permanently suspend the account from the market place

iii. Block the IP address from accessing our market place

iv. Commence legal actions against the account owner.

9.0 Revision of the Terms

Klyf Ghana reserves the right to from time to time revise these terms and Conditions. Any amended terms shall be effective immediately upon posting the amended version of such terms on klyfghana.com. Your continued use of our service shall be deemed as your acceptance of the amended are restated terms and conditions.
